Unang ratsada pa lang sa ere ng Forever in My Heart with lead stars Regine Velasquez, Richard Gomez and Ariel Rivera ng GMA-7 ay ‘tinadyakan’ na kaagad nito ang katapat na programa ni Kris Aquino titled Hiram ng ABS-CBN. As of last night’s ratings nakakuha ng 33 ang Forever in My Heart against 31 ng katapat nitong Hiram.

Kapuso outclasses Kapamilya

GMA 7 bagged two-thirds of the awards during the first Golden Screen for Entertainment TV Awards last Saturday.

‘Kapuso’ outclasses ‘Kapamilya’

BROADCAST network GMA 7 showed ABS-CBN which is better when it bagged 19 of the 28 trophies in the First Golden Screen for Entertainment TV Awards held Saturday night at the AFP Theater in Camp Aguinaldo, Quezon City.

This left the Lopez-owned network settling with only 10 awards.

Vic Zhou’s latest soon on GMA 7

Latest on F4: Vic Zhou has finished a teleserye called “Mars” which will be shown very soon on local TV, not on ABS CBN, but on GMA 7. Jerry Yan continues to make waves with his record-breaking debut CD “Jerry For you.” He donated $300,000 from his earnings to a young victim of that famous 9/11 tragedy in New York. ABS-CBN officials are liable for libel — GMA-7

Top ABS-CBN officials are responsible for libel when they accused GMA Network of “stealing” the live Reuters video footage of the arrival of Angelo dela Cruz last July 22.

GMA Network maintains that top ABS-CBN officials are accountable for the libel case filed by GMA against them in connection with the use of the live Reuters video footage of the arrival of Angelo dela Cruz last July 22.

In their joint consolidated reply to all counter-affidavits of the respondents submitted to the Quezon City Prosecutor’s Office yesterday (September 21), GMA Network said that ABS-CBN Chairman and CEO Eugenio Lopez III and President and COO Luis Alejandro along with News and Current Affairs officials Jose Ramon Olives, Jesus Maderazo, Luisita Cruz-Valdez, Jose Magsaysay, Jr., Alfonso Marquez, Beth Frondoso, Maria Progena Estonilo Reyes, Annie Eugenio, Dondi Garcia, news anchor Erwin Tulfo, and reporter Lynda Jumilla are all responsible for libel when ABS-CBN accused GMA Network of “stealing” the said video footage.

Last July 22, GMA used the live Reuters video feed of the arrival of De la Cruz in its afternoon news flash, unaware that the said footage came from ABS-CBN. When GMA News found out that an ABS-CBN reporter was appearing in the Reuters video feed, it immediately stopped airing the video feed from Reuters. ABS-CBN called GMA Network a “thief” in many occasions during its news programs aired the same evening and the following day.

Lopez, Alejandro and Olives, in their joint counter-affidavit, denied any knowledge of and participation in the incidents that led to the case stating that they “are not involved in any aspect of the day-to-day operations of ABS-CBN News and Current Affairs” particularly in the broadcast of “Insider” last July 22 and “Magandang Umaga Bayan” the following day.

GMA Network, however, said that Lopez’s, Alejandro’s, and Olives’ excuse is belied by the P200 million infringement case ABS-CBN filed against GMA-7 and its officials where ABS-CBN alleged that Gozon, Duavit, and GMA News and Public Affairs VP Marissa Flores as top officials of GMA-7, had full control over the overall operations of the network. GMA said that Lopez, Alejandro, and Olives can not state that they are not responsible for approving the airing of ABS-CBN’s broadcast after they alleged that their counterparts Gozon, Duavit, and Flores have the same responsibilities at GMA-7.

Since they (ABS-CBN) do not know the internal procedure and practice in the News and Public Affairs Department of GMA-7, they must have based their allegations on the internal procedure and practice of ABS-CBN. GMA-7 also said that the involvement of ABS-CBN’s top officials in the libel case is illuminated by the recent dislodging of ABS-CBN’s news programs by GMA-7’s in the ratings.

Maderazo, in his defense, said that he was “not privy to nor had foreknowledge or prior notice of the actual content or statements” to be used in ABS-CBN’s news programs, which GMA Network said was a “lie.” GMA said that Maderazo admitted in his counter-affidavit that he “controls and oversees production of all news programs and special news coverages; makes final decisions on production of news programs or cancellation of existing programs; have final say on any other news matters; and controls schedules of all news programs.”

He also said that he instructed Estonilo Reyes to proceed with the airing of the story considering the “importance and newsworthiness” of the matter, which, according to GMA, only meant that he was aware of the contents of the story and participated in the broadcast of the same.

Maderazo also offered the excuse that the term “pagnanakaw ng video” was only used to describe the incident and because there is no direct translation of the term “copyright infringement.” GMA-7, however, said that the term was used to portray GMA-7 to the public as “thieves” or “snatchers” of the footage as the term is clearly not equivalent to “copyright infringement,” which can be easily translated into Filipino other than “pagnanakaw.”

For their part, Magsaysay, Cruz-Valdez, and Marquez said that their job responsibilities are limited to supervision and are therefore not involved in the day-to-day operations of news and current affairs programs, which GMA-7 found incredible. GMA-7 said that it was incredible for Magsaysay to have no knowledge of, and participation in the airing of the libelous statements in the news programs “when he supervises and manages newsgathering, including news materials for both “Insider” and “Magandang Umaga Bayan.”

Marquez, on the other hand, can not deny his involvement in the airing of the libelous statements after he admitted in his affidavit that he was “deeply involved” in the production of the coverage of the arrival of Dela Cruz and was “intensely angered” by the airing of the same footage by GMA-7.

Valdez also can not deny her participation in the airing of the said statements even if she said that she only supervises current affairs programs as she admitted that ABS-CBN news and current affairs programs include “Insider” and “Magandang Umaga Bayan.”

GMA also said that Magsaysay, Marquez, and Valdez are members of the Management Committee, which has direct control and supervision over production of all news programs and special news coverages of ABS-CBN.

Tulfo, in his counter-affidavit, said that he merely reads the news and has no participation in the preparation of the script. This, according to GMA-7, “is no defense at all” since Tulfo “uttered, hurled and broadcasted the defamatory words complained of.” It can be recalled that while Tulfo was broadcasting the statements, there was also the live video of ABS-CBN’s bold graphics that read, “Ang pagnanakaw ba’y serbisyong totoo?” and the slug “Exclusive video ng ABS-CBN ninakaw ng GMA-7.”

Tulfo also made a lame excuse when he said that the words “pagnanakaw ng video” are not libelous per se because they simply state that GMA-7 made unauthorized use of ABS-CBN’s video footage and because there is no direct translation of the term “copyright infringement.” He also said that the statements he made in the news programs are factual and true and that he had good motives and justifiable intent in airing the same. GMA-7 said in using the term “unauthorized taking” in his counter-affidavit, Tulfo obviously refers to the crime of theft. GMA added that Tulfo’s words aired on ABS-CBN’s news programs are malicious as they “cast aspersions on the integrity and reputation of the network as well as on the character, honor and reputation” of the network and its officials.

By saying that his statements are factual, Tulfo is saying that GMA is actually guilty of “stealing” the said video footage, which is truly not the case. Jumilla, on the other hard, admitted that she prepared the script in her news report where she also said that GMA stole the video and that ABS-CBN was suing for infringement. She said that the broadcast was a fair and true report and that she, too, had justifiable motives and good intent in uttering and broadcasting the script.

Reyes, Garcia, Eugenio and Frondoso, who are involved in the production of news and public affairs programs “Insider,” “TV Patrol,” and “Magandang Umaga Bayan,” also said in their affidavits that the statements aired had no malice.

But GMA said that Jumilla’s statement simply means and conveys to the public “that GMA-7, its executive management, corporate officers, and managers in charge of news stole, snatched, and usurped their exclusive footage which contravenes GMA-7’s representation of ‘Serbisyong Totoo’ which is ‘malicious’ and ’seething with prejudice against GMA-7.”
