HI fella Kapuso and to the Kapamilyas visiting this Kapuso blogspot. In the name of honest information, i decided to make a little trip to where kapuso dhodjie made his remarkable inquiry regarding the proliferating issues about the Lopezes Group owning 80% of the MTV Europe and 75% of MTV Asia just so they could claim their so-called global dominance.
You see guys, when you say Lopez’ owned 80% of the shares of MTV Europe and 75% of MTV Asia, the implication would be is that the Lopezes is the controlling body for such mtv channels and they practically own it with only the remaining 20-25% share out for public offering. With that in mind, the Lopezes should therefore occupy the top spot positions of the management for each of these two mtv channels.
But sorry to say to the kapamilyas, following the lead of dhodjie, there is hardly any semblance of truth to such gossip. First, using the internal search engine of Viacom, the company that actually owns the MTV Networks which in turn owns MTV Europe & Asia, keying “lopez” of the abs-cbn fame will lead you to zero result, that is, there is no references in any of the lopez’s clan that connects them to the mtv networks and it’s affiliates.
Second, as I’ve said, if they (the Lopezes) owned 80% of the shareholder’s stocks of the MTV EUROPE, they would have occupied the top positions and these would have been out in most broadsheets. Isa akong 45 yr. old na tatay at alam ko na mahalaga din ang panonood ng telebisyon sa aking pamilya. Di ko ba alam kung bakit nagmumura ang mga kapamilya sa tuwing nakikita nila ang ratings ng GMA na mataas. Mga kapuso, ganyan po ba ang isang kapamilya?? walang MORALIDAD sa sarili?? BASTOS at PALAMURA?? Di ko po alam kung wala silang pakialam sa buhay o mukha lang po silang mga bulag sa katotohanan.ikaw PALANGGA (mr.putang_ina_nio_mga_kanguso), nakikita ko po sa iyo na wala ka talagang moralidad sa sarili at isa pa po, masyado po ikaw nagmamagaling. Nakakaya ko pang mag-po sa’yo kahit matanda ako. Mga kapuso, ganyan po ba ang ugali ni PALANGGA na parating nagmumura at makasarili? Hindi po sa ako ay naninira ng tao, tinuturuan ko lang ng leksyon. GMA Network has asked ABS-CBN to stop offering GMA’s DZBB-AM as part of the package of Philippine radio stations available for on-line subscription through the website of ABS-CBN’s International Program, The Filipino Channel (TFC).
In his letter to ABS-CBN President and COO Luis Alejandro, GMA Network Senior Vice-President for Radio Operations Miguel Enriquez said that GMA has not authorized ABS-CBN or TFC “to distribute, transmit, disseminate or rebroadcast DZBB through the internet or other means.”
Enriquez emphasized that GMA Network has the exclusive right to carry-out, authorize or prevent the rebroadcasting of its broadcasts and that TFC’s unauthorized distribution or transmission of DZBB through the internet infringes GMA’s intellectual property rights.
TFC offers twenty-six (26) local radio broadcasts in its website apart from ABS-CBN’s radio broadcasts, though it is not known whether they have sought the permission of the other radio stations who own the rights for said broadcasts. = from igma.tv)
RCA affirms RTC ruling on illegal use of GMA-7 video by ABS-CBN
The Court of Appeals has affirmed the ruling of the Quezon City Regional Trial Court, which found ABS-CBN guilty of copyright infringement for the unauthorized use of a GMA Network exclusive video in 1995.
In its decision dated August 6, 2004, the Court of Appeals, through the order of Associate Justice Juan Q. Enriquez, Jr. and concurred in by Associate Justices Salvador J. Valdez and Vicente Q. Roxas, sided with the RTC ruling that ABS-CBN failed to ask permission in broadcasting a GMA Network exclusive video of an interview with Vivialyn Dungca aired in the program Eye to Eye on October 12, 1995.
The said video was aired by ABS-CBN over the Star News segment of its news program, TV Patrol, on the same day. The words Eye to Eye Exclusive, which were superimposed on the GMA-7 video were covered by a red bar.
ABS-CBN admitted to the use of the said video but denied that it conspicuously concealed the words Eye to Eye Exclusive, claiming it was merely a computer error. ABS-CBN also claimed the said interview constitutes a news item or an editorial on current political, economic or religious topics which may be legally reproduced by the press for broadcast.
The RTC ruled on July 20, 2002 that ABS-CBN failed to attribute GMA Network as the source of the video. The RTC also said that ABS-CBN s excuse that the red bar appearing on the portion of the video aired by ABS-CBN was a computer error was flimsy to be given credence.
In its appeal, ABS-CBN argued that the video clip had no copyright notice stating the name of the copyright owner and the year of its first publication. ABS-CBN also claimed that GMA Network has no right to enforce the copyright of the said video footage since GMA Network is not the owner of said copyright.
They (ABS-CBN) likewise argued that since the video footage was a news item, the consent of GMA Network was not necessary.
The Court of Appeals disagreed and said that ABS-CBN violated Section 52 of P.D. 49 known as neighboring rights, which protects the interests of performers, producers of phonograms, and broadcasting organizations in relation to their activities in connection with the public use of authors works, all kinds of artists presentations or the communication to the public of events, information, and any sounds or images.
ABS-CBN, according to the Court of Appeals, not only failed to obtain the consent of GMA Network but also did not state the source of the news item in their newscast, which are important requirements under the law. = from igma.tv)

GMA Network has filed a P100M libel complaint against ABS-CBN Broadcasting Corporation Chairman and CEO Eugenio Lopez III, President and COO Luis Alejandro, news anchor Erwin Tulfo, reporter Lynda Jumilla and nine other officers before the Quezon City Assistant Prosecutor’s Office last Tuesday (July 27) after ABS-CBN “blatantly and repeatedly” accused GMA of stealing footage on the arrival of Angelo de la Cruz last July 22 in its news programs.
GMA Network Chairman, President and CEO Felipe Gozon, EVP and COO Gilberto Duavit, Jr., VP for News and Public Affairs Marissa Flores, News Director Jessica Soho, News Operations Head Grace dela Peña-Reyes, and News Program Manager John Oliver Manalastas personally filed the complaint against Lopez, Alejandro, Tulfo, Jumilla, and ABS-CBN officers including SVP for News and Current Affairs Jose Ramon Olivares, VP for News Operations Jesus Maderazo, VP for News Productions Luisita Cruz-Valdes, AVP for News Operations Jose Magsaysay, Jr., Director for News Operations Alfonso Marquez, INSIDER Executive Producer Beth Frondoso, Magandang Umaga Bayan Supervising Producer Maria Progena Estonilo Reyes, Magandang Umaga Bayan Executive Producer Annie Eugenio, and News Patrol Executive Producer Dondi Garcia.
The complaint stemmed from the statements of Tulfo and Jumilla against GMA Network made in ABS-CBN’s news program Insider last July 22 and morning current affairs program Magandang Umaga Bayan last July 23.
INSIDER news anchor Erwin Tulfo and reporter Lynda Jumilla called GMA Network Inc. a thief during their program last July 22. The same remarks were made by Tulfo and Jumilla in Magandang Umaga Bayan the following day.
In the said INSIDER episode, ABS-CBN showed on live video bold graphics that read, “Ang pagnanakaw ba’y serbisyong totoo?” In the same program, ABS-CBN likewise showed the slug, “Exclusive video ng ABS-CBN ninakaw ng GMA-7.”
Tulfo read the news in INSIDER, part of which was the statement, “Kaya nakakalungkot po na may ibang istasyon na nagnakaw ng aming ekslusibong kuha.” He also said at the end of the report, “Okay lang ho sana ang pagsisinungaling pero ang pagnanakaw ay isang malaking krimen.”
In the same news program, reporter Lynda Jumilla stated in her news report, “Ang mga ekslusibong video na kuha ng ABS-CBN news lumalabas din sa GMA-7. Mula paglabas ni dela Cruz sa eroplano, pagdaan sa tube, hanggang sa pagpasok sa VIP lounge. Pati mga eksena sa press conference, kinuha din mula sa video ng ABS-CBN.” Jumilla added, “Pinag-iisipan ng ABS-CBN na sampahan ng kaso ang GMA-7 dahil sa pagnanakaw ng video.”
Tulfo also made the same derogatory remarks in Magandang Umaga Bayan the following day while Lynda Jumilla’s report was also aired in the same program.
GMA Chairman, President and CEO Felipe Gozon said that ABS-CBN’s malicious statements gave GMA no other recourse but to file the complaint. “Kahit sino siguro ay hindi magugustuhan kung tatawagin na magnanakaw, lalo na kung hindi totoo. GMA 7 was found liable for copyright infringement of ABS-CBN’s Angelo de la Cruz news footage, which GMA 7 aired during the latter’s coverage of De la Cruz’s arrival from the Middle East last July 22, 2004.
In a resolution dated December 3, 2004, issued by Quezon City Assistant Prosecutor Dindo G. Venturanza, GMA 7 officials Grace de la Peña-Reyes and John Oliver Manalastas were found to have committed the copyright infringement.
They were charged of violation of Sec. 177 and Sec. 211 of Republic Act 8293, otherwise known as Intellectual Property Code. Reyes is the head of news operations and Manalastas is program manager of GMA 7.
The resolution stated that ABS-CBN holds the exclusive ownership and copyright of the Angelo de la Cruz news footage. Hence, any airing and re-broadcast of the said footage without any consent or authority from ABS-CBN will be held as an infringement and violation of intellectual property rights of the latter.
Venturanza pointed out that Reyes and Manalastas cannot escape liability since the news control room was under their direct control and supervision.

maybe the poster should realize that gma’s liability was only expressed by a prosecutor through a resolution. mr dindo venturanza is not the judge in the case if there was a case filed already, and therefore such pronouncement may not be final and executory.
on the other hand, the prosecutor should have realized that abs-cbn has already lost authority to their story when they allowed wire services such as reuters and cnn to carry their story.
simple and basic logic dictates that once you give away something to someone, you don’t anymore have any right to that something if that someone shares or gives it away to anyone else.
it cannot be argued that abs-cbn only licensed the said video because wire services are free on their own to re-distribute the said video without having to inform the original source.
it is therefore arguable that if abs-cbn wanted to protect the video in arguement, they should not have allowed other wire services to carry the story and the accompanying video. plain and simple.
further, abs-cbn failed to post their logo in the said video. common sense also asks, how can one know that the video in arguement was owned by abs-cbn when gma got it from reuters and cnn, and when wire services are not required to indicate their sources?
further, a prosecutor cannot pronounce a defendant as guilty. only a presiding judge, the court of appeals, and/or the supreme court can.
on final note, why don’t abs-cbn file charges against cnn and reuters for re-destributing an exclusive video to competitors? i bet they can’t!

sori didn’t come across your jan.6th posted message about the term “Kapuso”. Let me ask you…what is your point having to compare the words “Kapuso” and “Kapamilya” in the dictionary? Does it take away GMA7 current success? The prefix “Ka” means in association with something or someone. You said kapamilya being in the dictionary and kapuso isn’t? So what is the point? Does that stop anyone from creating a word or a phrase that which would expresses one’s thoughts the most.
Let me tell you this…years ago, there is nowhere in the dictionary where you can find the word “bucalonic”, which the americans invented to refer to a person with body hairs such as chest, arms,etc. but lacks one on top of their heads. The etymology of the world “bucalonic” was actually a tagalog term “bokal” which is our endearment to people with bald top. This is one reason why dictionary gets reprinted every year because new words get to be used so commonly they end up becoming a standard term.
Your kapamilyas used the derogatory quasi-terms “kanguso and kasuso” against us but are they in the dictionary. quasi means something temporarily and non-standard.
so your inquiry about the terms is really pointless.
one last point…is the word BIBLE ever been in the bible itself? No. The word most close to it is Scripture. Nowhere is the word “bible” ever been in the bible. That is the point. You dont stop anyone from expressing one’s concept in a manner most suitable.

quicktimer…about the earnings of GMA7, true, they do have a cheaper commercial rate compare to ABS-CBN which is much favorable to advertisers and the current rate they are doin (with what you call commercial overloading) is perfectly ok because they are rating so well di ba which means the the advertisers realized GMA7 now has the upperhand on audience shares and that is a big factor to them.
but is that really the reason for GMA7 to withdrew their KBP membership? So they can getaway with commercial overloading? Hardly. The real reason was the impartiality of KBP of GMA7 with issues involving their respective talent/stars found guilty of violating certain TV ethics among them Rosanna Roces, Willie Revillame and John Estrada. The suspension of Roces and not Revillame & Estrada to certain issues showed the bias of KBP which was not really surprising because the KBP was manned mostly by the Lopezes themselves. You should check the top brass behind KBP and the Lopezes is among them.
about the MTV Europe and MTV Asia…i’ve done my research myself and as i’ve said Viacom owns MTV Networks which wholly owned both regional mtv channels. The Lopezes having stocks is not far but the 80%-50% share with MTV Europe & MTV Asia respectively is a controlling amount of share that is they have the upper hand to decide on the future on such endeavors. Investors relation with MTV Networks doesn’t reveal any lopezes in it neither is keying “lopez (of the abs-cbn fame)” in viacom’s internal search engine pertains to any of the newsbit article concerning shares. it showed zer result. the only lopez in it is jennifer lopez and richard lopez, famed puerto rican stars. Consequently, neither is any investment with these two regional mtv channels appears in the business investment portfolio of ABS-CBN itself nor of their mother company Benpres Holdings where they have a graphic outline of the investments of the Lopezes Group. With such shares i see no reasons to hide is there? show me an investment portfolio of the lopezes where mtv europe & mtv asia is among them. their websites are updated as far as i’m concerned which should be given the wealth they have, updating their website isn’t much to do.

I have seen the heydays of the GMA network during and after the Marcos regime. After the Lopezes were able to regain ABS-CBN, I am among those who criticize GMA for having a heavily-canned programming. Although I would say I am a GMA fan, I was among those who celebrated the metroric rise of ABS-CBN because they championed local productions. However, things became too comfortable for ABS-CBN and they slowly degenerated into commercialism. There was even a point when we would joke about a TV Patrol: The Movie or The World Tonight: The Movie or Hoy! Gising: The Movie because ABS-CBN practically brought to the big screen almost all their successful television production. Then, GMA decided to take the challenge head on and started to Filipinized their programming. Although ABS-CBN managed to keep the competition at bay, GMA made sure ABS-CBN cannot simply rest on their laurels.
Unfortunately, ABS-CBN got it wrong and instead resorted to simply reacting to GMA by imitating GMA’s programming.
Today, I am glad that the patience of GMA has finally paid off. The new leadership at GMA also provided the network tougher impetus. Although the network wars is not yet over, there is no arguing that GMA has finally regained its pre-1986 eminence with an impressive programming that balances commercial appeal, broadcast responsibility and creative revolution.
I hope GMA will be able to maintain this stature and not fall into the same complacency where ABS-CBN fell. No allow the victories and achievements to go beyond their head.
My wish list for GMA:
1. Do not allow itself to be involved with talent piracy and to publicly take a strong position againt talent piracy in the same manner we condemn CD piracy. Be the vanguard of network dicipline and loyalty. If necessary, do not sign up talents from rival networks if there are available talents in the Artist Center .
2. Train the technical people to come up with slicker and glossy productions. Make all television productions movie-like.
3. If there is a need to come up with a similar program, make sure to come up with better scripts, twists and plots.
4. Bring back the Bahag-hari Awards. I remember this is among the shining moments of GMA when ABS-CBN was slowly dominating the ratings game. This will also assert the quality of GMA talents and encourage them to pursue excellence.
5. Be aggresive in expanding to the different provinces and abroad. It is time GMA give ABS-CBN the scare it deserve. I was in the Middle East for three years and we were captives of the mediocre TFC programming. I assure you, Filipinos abroad have long been wanting an alternative.
For the meantime, I say Extra Challenge should inspire GMA that the creative risk was worth it all. Mulawin is another breakthrough. It was sad Out! can not withstand the pressure of our the so-called “moralists” in our society.
The rainbow comes appear the storm. Finally, we see the rainbow in the heart of GMA, truly a kapuso – kapuso ng manonood na Pilipino.

Excited na si Sunshine Cruz at ang mister niyang si Cesar Montano sa hamon ng Extra Challenge ng GMA 7 na gagawin sa Korea soon. Minsan daw kasi ay naikuwento ng pinsan ni Shine na si Geneva Cruz ang mga naransan niya noong sumali siya rito last year.
Si Cesar naman ay happy dahil finally ay magkakasama sila ng kanyang misis sa isang show na susubok sa kanilang tiwala at pagmamahal sa isa’t isa. Napaka-adventurous nitong si Buboy kaya piece of cake para sa kanya ang mga ipapagawa sa kanya.

Eh, saan ba nila nakuha ang result na ito? Pakilinaw lang po.
One thing, Kapamilya na pala si Direk Joel Lamangan. Sana, hindi siya matulad sa iba na lumipat sa ABS-CBN gaya nina Arnell Ignacio, Assunta da Rossi, Vina Morales at Onemig Bondoc. Sana di sila magsisi sa bandang huli.
Regarding GMA International, magkakaroon na sana sila ng launch next month, hopefully dito sa Dubai or Middle East. Maraming mga Pinoy rito sa Dubai ang excited na mag-subcribe. Paulit-ulit o palagi kasing replay ang mga programa ng ABS-CBN na ipinalalabas sa TFC.
What I mean by palaging replay? Ipinalabas na sa TFC, then ipalalabas pa rin sa ANC then on the following day ire-replay na naman.
Excited na kami na mapanood ang Eat Bulaga, Sis, SOP, Bubble Gang, I Witness, 24 Oras, Startalk, S-Files, Extra Challenge, Debate, Master Showman at lahat ng mga shows ng Channel 7 para maiba naman.
Sana po makarating ito sa pamunuan ng GMA-7 na sooner or later ay magkaroon na rin sila ng GMA international. Congratulation sa kanila. Kaya nga rito (Dubai) ang TFC ay may promo na murang singil sa mga gustong magpa-subscribe at after 4 months pa ang payment. Dapat sampalin ng ratings itong si Mr. Salut, as in SALUT talaga, kasi di bale ng magsinungaling sa Column niya, basta kampihan lang ang programa ng Dos, kung saan may Payroll siya. Kung totoo ok lang, pero kailan ba ito nagsasabi ng totoo?
